(plaintiff), the well-known leather goods maker holding trademarks in "Coach," objected to Koko Island's (defendant) application for a new generic top-level domain matching that trademark; Koko Island had applied for over 300 gTLDs, many consisting of common dictionary words, and there was no evidence it intended to target or infringe Coach's mark rather than offer domains related to the word's other common meanings (such as sports or transportation coaching).
Whether a generic top-level domain string will be allowed to be registered over a trademark holder's objection if the string takes unfair advantage of or unjustifiably impairs the objector's trademark, or creates an impermissible likelihood of confusion.
