The FTC brought unfair-trade-practices charges against Cinderella Career and Finishing Schools (defendant); a hearing examiner dismissed the charges, and on the FTC's internal appeal, the full Commission reversed on six of thirteen counts. While that appeal was pending before him, FTC Chairman Paul Rand Dixon gave a speech containing comments indicating he believed practices like Cinderella's were unfair and deceptive. Cinderella appealed the Commission's decision to the D.C. Circuit, arguing Dixon was biased and should have been disqualified.
Whether an agency official may be disqualified from hearing a matter if he makes comments indicating or giving the appearance that he has prejudged the matter.
