Chicago Coliseum Club v. Dempsey
Illinois Appellate Court
265 Ill. App. 542 (1932)
Chicago Coliseum Club (plaintiff) signed separate contracts with boxers Wills and Dempsey (defendant) to promote a heavyweight championship fight, paying Dempsey $10 and a stadium architect $300 to design the ring after signing; when Dempsey later informed Coliseum he was training for a different fight against Gene Tunney and wouldn't honor the agreement, Coliseum unsuccessfully sued in Indiana to enjoin the other fight, then sued in Illinois for lost profits, pre-Dempsey-contract expenses tied to the Wills deal, post-breach litigation expenses, and expenses incurred between signing and breach.
Whether a plaintiff in a breach of contract action may recover speculative lost profits, expenses incurred before the breaching contract was signed, or expenses incurred after the breach occurred, in addition to expenses incurred during the contract's operative period.
