National Guard clerk Benward (defendant) and her supervisor Sisk (defendant) offered to help Cash (plaintiff) submit a spousal life-insurance application unrelated to the Guard, but Benward lost or mishandled the first application and check, and by the time Sisk gave Cash a new application to complete himself, Cash's wife fell ill and died before the insurance was secured. Cash sued for breach of contract, the trial court granted summary judgment for Benward and Sisk finding no consideration, and Cash appealed.
