The defendants purchased real estate under a land sale contract, and after a judgment was later entered against them, the property was assigned to intervening respondents whose interest was based on that vendee's contract interest; the judgment creditor (plaintiff) sought to execute against the property under a statute allowing a judgment debtor's real estate to satisfy the judgment, but the respondents argued their vendee's interest wasn't real estate under the old rule that a land sale contract conveys no interest to the vendee. The trial court granted the respondents summary judgment and stopped the sale, and the plaintiff appealed.
