Butler v. Rigsby
United States District Court for the Eastern District of Louisiana
1998 U.S. Dist. LEXIS 4618 (E.D. La. 1998)
In a personal-injury suit brought by Butler and others (plaintiffs) against Rigsby (defendant), Rigsby sought discovery from two medical providers, American Medical Group (AMG) and Midtown Health Care (MHC), covering the number of patients referred to them by plaintiffs' attorneys, their net income and the litigation-related share of it, and lists of their patients; AMG and MHC moved for a protective order shielding all of this information, which the court denied, and they appealed.
Whether evidence of a relationship between an expert witness and attorney, evidence of litigation-related income, and patient records are each discoverable.
