Bushel v. Miller
Court of King's Bench
93 Eng. Rep. 428 (1718)
Relevant factsFree
Two porters, the plaintiff and the defendant, shared a hut at a wharf to store goods awaiting shipment, each entitled to use part of the space. When the plaintiff's stored goods blocked the defendant's own space, the defendant moved the goods aside to access his portion but failed to return them to their original spot, after which the goods were lost; the plaintiff, having reimbursed the goods' owner, sued the defendant for conversion.
IssueFree
Whether a defendant can be guilty of conversion if he simply moved the goods in question to another location but did not actually convert them to his own use.
