Borer v. American Airlines, Inc.

California Supreme Court

563 P.2d 858 (Cal. 1977)

Relevant factsFree

Patricia Borer was injured by a falling light fixture in a terminal owned by American Airlines (defendant). Her nine children (plaintiffs) sued, alleging that their mother's injuries deprived each of them of her services, society, companionship, affection, guidance, and instruction. American demurred for failure to state a cause of action. The trial court sustained the demurrer without leave to amend and dismissed. The plaintiffs appealed. (A companion case, Baxter v. Superior Court, involved parents' claim for loss of a child's companionship.)

IssueFree

Whether a cause of action for loss of consortium extends beyond the marital relationship to a child's claim for loss of parental consortium.
