Richard Friedberg (defendant) hired Eugene Blanton (plaintiff) under separate agreements to develop two land tracts, paying him through commissions, fees, and expense reimbursement. Friedberg fired Blanton before either project was finished, and Blanton sued for breach of contract and, alternatively, quantum meruit for his unpaid work and expenses. The jury awarded Blanton $394,525 for quantum meruit based largely on commissions and fees he anticipated receiving had the projects been completed. Friedberg appealed.
