Nancy and James Biglane (plaintiffs) lived next door to Under the Hill Saloon (defendant). The Saloon regularly played loud music late into the night, sometimes forcing Mrs. Biglane to sleep elsewhere, and the problem worsened in summer when the Saloon left its doors and windows open. The Biglanes sued for private nuisance. The trial court agreed and ordered the Saloon to keep its doors and windows closed while music played. The Saloon appealed.
