Best Signs (plaintiff) bought a truck from dealer Bobby King (defendant) that needed repairs, and later gave the truck back to King to fix. Instead of repairing it, King sold the truck to a third party, Design Team (defendant), and was later arrested. Best sued both King and Design Team to get the truck back, arguing King never had title and so could not have transferred any rights to Design Team. The trial court ruled for Design Team, and Best appealed.
