Nearly 15-year-old George Barker built a pipe bomb with the Kallash brothers using gunpowder from his father's shotgun-reloading workshop; the bomb exploded and injured Barker's hands. Barker claimed the gunpowder actually traced back through a chain of minors who bought fireworks, and his father (plaintiff) sued the other boys and their parents (defendants) for negligent supervision. The trial court dismissed claims against one set of defendants, and the appellate court affirmed; Barker appealed to New York's highest court.
