Bank of America N.T.S.A v. Sanati
Court of Appeal of California
14 Cal. Rptr. 2d 615 (1992)
Relevant factsFree
After Mr. Sanati left his family, he instructed Bank of America's London branch to wire his account's monthly interest to a joint account he held with his estranged wife, Mrs. Sanati (defendant), in California, but the London branch mistakenly wired the account's entire principal instead. Mrs. Sanati and their children withdrew the full erroneous transfer, and when Bank of America (plaintiff) demanded reimbursement, they refused; the trial court granted Bank of America summary judgment for restitution, and the defendants appealed.
IssueFree
Whether a bank that erroneously wires more than the amount its customer authorized may recover the excess from the beneficiary.
