Adolf Eichmann (defendant), a German Nazi officer who had fled to Argentina after World War II, was kidnapped by Israeli agents and forcibly brought to Israel to face war-crimes charges. Eichmann challenged Israel's jurisdiction over him as tainted by the illegal manner of his capture. Argentina had initially protested the kidnapping to the U.N. Security Council as a violation of its sovereignty, but before Eichmann's indictment, Argentina and Israel settled the dispute, with Argentina absolving Israel of responsibility for the kidnapping.
Whether, under international law, a defendant may challenge a court's exercise of jurisdiction on the ground that he was illegally arrested or kidnapped to bring him within that jurisdiction.
