The Telecommunications Act of 1996 required local exchange carriers (LECs) to share their networks with competitors, and the FCC implemented "Rule 319," requiring LECs to provide requesting carriers access to at least seven network elements. A group of LECs and state commissions sued AT&T and the FCC (defendants), arguing that Section 201(b) of the Act limited FCC rulemaking authority to purely interstate matters, and thus the FCC lacked power to regulate local telephone service at all. The Eighth Circuit agreed with the LECs, and the Supreme Court granted certiorari.
