Aleynikov (plaintiff), a vice president at Goldman's subsidiary partnership GSCo, was convicted then acquitted on retrial of federal trade-secret theft charges, and was later separately indicted in New York state court on related charges; he sued Goldman Sachs Group (defendant) seeking indemnification for his federal case expenses and advancement of expenses in the ongoing state case under bylaws covering current or former officers of the corporation or its subsidiaries.
