After the trial court denied Alan's (plaintiff) class-certification motion against Honda (defendant), the clerk mailed two separate documents in one envelope: a file-stamped "Statement of Decision" and an unstamped minute order that alone showed the mailing date. Honda later served its own "Notice of Entry" document, and Alan filed his notice of appeal 63 days after the clerk's mailing but only 44 days after Honda's service; the Court of Appeal dismissed the appeal as untimely, treating the clerk's mailing as triggering the shorter deadline.
Whether, under the California Rules of Court, the deadline to file a notice of appeal is triggered only when the clerk mails a single document containing all elements required by the rule.
