Epstein (defendant) left the law firm Adler Barish (plaintiff) but was allowed to keep using his old office for about a week to wrap up his affairs. He used that time and access to contact Adler Barish clients by phone, in person, and by mailing them pre-addressed, ready-to-sign forms switching their representation to his new firm — conduct that also violated professional-responsibility rules. Adler Barish sued for intentional interference with its client contracts; the trial court granted an injunction against Epstein, but the superior court reversed it.
Whether an attorney's proactive solicitation of his former law firm's clients is improper enough to amount to intentional interference with the performance of a third-party contract.
