Under the Uniform Commercial Code (UCC) § 2-608(1), a buyer may revoke his acceptance of nonconforming goods if the nonconformity substantially impairs the value of the goods to him.
Relevant Facts
Arthur and Roswitha Waddell purchased an RV from Wheeler’s Las Vegas RV (Wheeler’s), which experienced chronic engine overheating and other problems. Over 18 months, the RV spent seven months at Wheeler’s for repairs, many of which were unsuccessful. The Waddells intended to use the RV for traveling for two to three years. They sued Wheeler’s for revocation of their acceptance of the RV, and the district court held in their favor.
