Two or more persons may be held jointly and severally liable for their independent and consecutive acts of negligence that together causes an indivisible harm to another.
Relevant Facts
Bondy (the plaintiff) was walking in a crosswalk when she was hit by a car driven by Allen. An ambulance operated by Gold Cross Ambulance Service, Inc. (the defendant) was called and arrived at the scene. The paramedic placed the plaintiff on a gurney with safety straps and assessed the plaintiff’s injuries on the way to the hospital. During the assessments, the paramedic removed some of the safety straps to inspect the plaintiff’s legs. This caused the plaintiff to fall off the gurney, causing additional pain to the plaintiff. The plaintiff sued Allen and Gold Cross Ambulance Service, Inc., alleging negligence. Gold Cross Ambulance Service, Inc. moved for summary judgment, arguing a lack of compensable damages. The trial court denied the motion.
At trial, Allen settled with the plaintiff. The remaining defendant (Gold Cross Ambulance Service, Inc.) then moved to exclude all evidence of the damages caused by the car accident. The trial court granted summary judgment to the defendant, and the plaintiff appealed.
