Klaus Zurstrassen, while in Germany, had his interests in two lots fraudulently conveyed by his brother Rolf to Stonier. Stonier then sold one of the lots to the Wihlborgs. Klaus sued to quiet title, but Stonier and the Wihlborgs claimed Klaus was estopped from any claim due to an agreement with Rolf acknowledging title in Rolf’s name.
