Personal jurisdiction may not be exercised over a nonresident civil defendant if the defendant's only contact with the forum state is knowledge that their tortious conduct committed outside the forum state has an effect on the plaintiff in that state. For personal jurisdiction consistent with due process, the defendant must have substantial personal contacts or connection with the forum state, arising from contacts that the defendant himself creates with the forum state.
Relevant Facts
Gina Fiore and Keith Gipson, plaintiffs, both residents of California and Nevada, were detained at an airport in Puerto Rico by TSA agents who found nearly $97,000 in cash in Fiore's bag. The plaintiffs, professional gamblers, explained they won the money at a San Juan casino. Law-enforcement officials in San Juan informed a DEA task force in Atlanta, Georgia, about the plaintiffs' arrival there. Anthony Walden, a police officer and member of the DEA task force, along with the task force, approached the plaintiffs in Atlanta, questioned them, and seized the cash, despite Fiore's explanation. The money was later returned. The plaintiffs filed suit against Walden in Nevada, alleging damages under Bivens v. Six Unknown Federal Narcotics Agents. Walden moved to dismiss the complaint, arguing the Nevada court lacked personal jurisdiction over him.
