Under the voluntary undertaking doctrine, one who voluntarily undertakes to render services to another is liable for any harm caused by their failure to perform these services with reasonable care.
Relevant Facts
Wakulich, a 16-year-old girl, was at the home of the Mraz brothers. After being dared, she drank an entire bottle of liquor, lost consciousness, and began vomiting. The Mraz brothers moved her downstairs, changed her vomit-soaked shirt, placed a pillow under her head, and later took her to a friend’s house. They prevented other family members from calling 911. Wakulich was eventually taken to a hospital by her friend but died of alcohol poisoning. Her family sued the Mraz brothers, alleging wrongful death due to negligence in the care provided by the brothers.
