“Reliability is the linchpin” in determining the admissibility of identification testimony for confrontations. Weighing the factors against the circumstances of the case, the identification was reliable. The officer was trained and had sufficient opportunity to view the suspect and accurately describe and identify Brathwaite. Furthermore, only two days elapsed between the crime and the confrontation.

Relevant Facts

An undercover police officer purchases narcotics from a dealer. One undercover officer was able to see the dealer up close for several minutes, and described him to another co-officer, who then obtained a photo of the defendant (Brathwaite) and left it at the original officer’s desk. Subsequently, the officer was able to identify the person in the photograph as the dealer. At trial, the undercover officer provided an in-court identification of Brathwaite. the photograph was successfully admitted into evidence, and Brathwaite was convicted.
