Relevant Facts
Bohrmann and other chemistry students (the plaintiffs) went on a tour of Maine Yankee Atomic Power Company’s (the defendant) power plant. Two weeks earlier, a radioactive gas leak occurred at the plant. The repairs included flushing out hot spots in the plant’s demineralizer, a process that the defendant knew would lead to a release of radioactive gas. The repair was conducted during the plaintiffs’ tour. As a result, the plaintiffs tested positive for radiation exposure at the conclusion of the tour. Additionally, Bohrmann experienced a significant decrease in his white blood-cell count. The plaintiffs brought suit for battery. The defendants responded that they were in compliance with federal nuclear power-plant safety standards.
